Introduction

These Terms and Conditions (‘the Terms’) form part of every contract made between Zellner Services (ZS) and the Client for the supply of goods and services by ZS.

Service Times

Service times which are quoted are target times only and ZS reserves the right to vary services times to the extent permitted by law.

Care for your materials

ZS will treat your important memories with care and respect. However, due to the uncertainty/variations of media (for example, due to its age, expiration of unexposed film, physical condition when given to ZS or poor original quality) there are often deviations from product standards. We cannot guarantee that incidental or accidental damage will not occur during handling or storage. Old or delicate media, including photographs, mounted slides and brittle documents are more susceptible to damage.

(b) ZS will not be liable for the loss or corruption of any digital information left or supplied to ZS by the Client. It is the responsibility of the Client to create and retain back-ups of all digital information supplied to ZSAfter consultation with the client, concessions or refunds may be negotiated if needed, on a case by case basis.

Secure Storage of electronic images

If you use our digitization services, then electronic copies of your images may be held on our local computer systems. We do not keep images indefinitely unless requested to do so. Any image files greater than twelve months old are deleted permanently from our systems.

Confidentiality and Privacy

ZS shall use the same degree of care to safeguard the Customers confidential information as it uses to safeguard its own. We value your privacy and will not share any of your information or materials with others.

We will only use the personal information you provide to us to supply the services and products to you, to process your payment for the services and products and to provide you with support after you have received the products.

Shredding will be stored in secure manner, processed quickly and recycled. Prior to the commencement of work, customers can request shredded material to be returned to them.

Copyright & Moral Rights

ZS will claim no copyright in material submitted to ZS by virtue of work undertaken by ZS on behalf of the Client.

The Client further warrants that all film, negatives, digital media and electronic files deposited with or sent to ZS do not contain any material which is illicit, unlawful, defamatory, obscene or intrusive.

Governing Law & Liability
These terms and conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Australia.

Zellner Services will not be liable for any failure to perform any contract between ZS and the Client which is due to any circumstances beyond ZS control including (but not limited to): inability to secure labour, materials, supplies or transport, or scarcity of fuel, power or components (including computer software and hardware), or machine breakdown (including computer, server, ISP network), theft, vandalism, fire, storm, flood, war, civil disturbance, strikes, lock-outs, or industrial action (of any form).
